Terms of Service

1. Acceptance of Terms

By accessing or using this application, you agree to be bound by these Terms of Service. This platform is provided by Courton ("Platform Provider") to various Padel Clubs ("the Club"). Your use of the service constitutes agreement with both the Club's internal rules and these platform-wide terms.

2. Courton's Role

Courton provides the software-as-a-service infrastructure that enables Padel Clubs to manage their operations. Courton is not a party to the actual booking contract between you and the Club, except where specifically noted (e.g., in technical support contexts).

3. User Accounts

To utilize the platform, you must create a secure account. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Providing accurate and up-to-date information.

4. Bookings and Payments

All matches, lessons, and events booked through the platform are subject to the specific rules and pricing of the host Club.

• Payments: Handled securely via our integration with iyzico.
• Cancellations: Subject to the Club's specific cancellation window and refund policy.
• Fees: Transaction fees may apply depending on the payment method chosen.

5. Platform Availability

While Courton strives for 99.9% uptime, we do not guarantee that the service will be uninterrupted or error-free. We reserve the right to perform scheduled maintenance or emergency updates to ensure platform integrity and security.

6. Prohibited Conduct

Users agree not to engage in any activity that:

• Interferes with the technical operation of the Courton platform.
• Attempts to bypass security measures or access data of other users/clubs.
• Uses automated systems (bots) to scrape data or create bulk bookings.
• Violates any local, national, or international laws.

7. Limitation of Liability

To the maximum extent permitted by law, Courton's total aggregate liability arising out of or in connection with your use of the platform shall be limited to the refund of the amounts actually paid by you to Courton in connection with the relevant transaction. Courton cannot be held liable for any damage, loss, obligation, or claim other than the refund of the payments it has received:

• Any event, accident, injury, or damage (including health issues and property damage) arising from the Club's premises, services, staff, equipment, or operations.
• Any dispute between the Club and you concerning bookings, cancellations, rescheduling, or the quality of services.
• Acts or omissions of payment processors (iyzico), hosting and infrastructure providers, or other third-party service providers, including their outages.
• Indirect, incidental, special, or consequential damages (including loss of data, revenue, or profits).

8. Governing Law

These terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law principles. Any disputes shall be settled in the competent courts of of the court provider.

9. Changes to Terms

We may update these terms from time to time. Continued use of the platform after such changes constitutes your acceptance of the new terms.
